The short version

  • TalkHook puts a call-me-back button on your website and alerts you when someone uses it. You make the call.
  • Monthly or yearly, paid in advance, no contract. Cancel any time and it runs to the end of the period you paid for.
  • You're responsible for calling people back and for following the rules on calls and texts.
  • Don't hide the badge on the Standard plan, and don't use TalkHook for spam.

1. Who these terms are between

These terms are an agreement between you and Fontus Marketing LLC, 2709 N Hayden Island Dr, STE 117484, Portland, OR 97217 (“we”, “us”), which makes and sells TalkHook. They apply when you buy or use TalkHook, and when you use talkhook.com or talkhook.app. If you accept them for a business, you confirm that you can agree for that business, and “you” means the business.

2. What TalkHook does

TalkHook adds a button to your website. A visitor leaves their name and number and asks for a call now, a call at a time they pick, or a message. We text you an alert with a link that dials them from your phone, remind you if nobody calls, and send the visitor texts about their request.

TalkHook does not place calls for you or answer your phone. Whether and when someone gets called back is up to you.

TalkHook is offered to businesses in the United States and Canada. The button accepts US and Canadian cell numbers, and its text messages are sent from a US number. If we agree to serve a business elsewhere, we'll confirm the countries and any added fee in writing first.

3. Setting up

We create your install and give you one line of code to paste into your site. You agree to give us accurate details (your business name, the phone number and email for alerts, your opening hours and your website address) and to tell us when they change. Your install works only on the website addresses registered to it.

5. Fair use

Each plan includes about 250 successful callbacks a month per website. That's a fair-use line, not a meter. If you go well past it, we'll contact you to talk about it. We won't switch your button off for that, and we won't charge you extra without your agreement.

6. The badge

On the Standard plan, the button shows a small “Powered by TalkHook” badge. You agree not to hide, cover or change it. The button checks that the badge is visible, and it stops passing on requests if it isn't. The Pro plan has no badge. On the Agency plan, the badge shows your agency's name.

We may suspend an install that breaks these rules. Where we reasonably can, we'll tell you first.

9. Demos and previews

The demo on talkhook.com and the previews on talkhook.app are there to help you judge TalkHook. A preview shows one public page of a website with our button added. Nothing is installed on that website, and the preview is labeled as one. Only preview sites you own or represent, and don't use a preview to mislead anyone.

10. Ownership

TalkHook, its code, design and name belong to us. While you're a customer, we give you permission to use the button on your registered websites. You own your business information and your customers' details. You let us use them only to run TalkHook for you.

11. No guarantees

TalkHook is provided “as is.” We work hard to keep it running, but we don't promise it will never be interrupted, that every message will be delivered, or that it will bring you any particular number of leads or sales. To the extent the law allows, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

12. Limits on liability

To the extent the law allows, we are not liable for lost profits, lost business, or indirect, incidental or consequential damages. Our total liability for any claim about TalkHook is limited to what you paid us for it in the 12 months before the claim.

13. If you cause a claim against us

If someone makes a claim against us because of how you used TalkHook, such as calls or texts you made, or information you gave us that you weren't allowed to share, you agree to cover our reasonable costs of dealing with it.

14. Ending the agreement

You can cancel at any time (see section 4). We can end these terms with 30 days' notice, or straight away if you seriously break them. When they end, your button stops showing. Sections 10 to 15 still apply afterward.

15. The legal details

Minnesota law governs these terms. Any dispute will be handled in the state or federal courts of Hennepin County, Minnesota. If part of these terms can't be enforced, the rest still applies. These terms, together with our Privacy Policy, are the whole agreement between us about TalkHook.

16. Changes

We may update these terms. We'll change the date at the top, and we'll tell customers about important changes at least 30 days before they take effect.
